My question involves criminal law for the state of: Minnesota.
A friend of mine was recently arrest for Sexual Assault in the 5th Degree. He has not been formally charged yet. We were told they have up to 48 hours to officially charge him. We were also told they usually take all 48 hour to decide to charge or release.
So the crux of the situation is as follows. He is an adult male, his victim is an adult female. I know there shouldn't be any excuse for sexual misconduct, so I am not debating that. I am just trying to give you an idea of what happend.
He said to this person I bet you 5 dollars I can feel your breasts without touching them. He then proceeds to brush her breast with his hand and then says oops I lose here is your five dollars.
So my main question in this rant. He has never been convicted of any misdemeanor, felonies, or even parking ticket for that matter. Is there any precedents where he could plead down to something other than anything with the word "Sexual" in the charge?
Maybe simple assualt. Not sure.
