    Default I Dropped My Friend Off and He Left His Pipe. I Got the Possession Ticket

    My question involves criminal law for the state of: Texas
    I picked up one of my friends because we were going to see a movie. Without me knowing he had brought marijuana and a pipe. He kept asking if I wanted any and i said no. Well we watched the movie and I dropped him off at his house. On my way home i got pulled over for not using a turn signal. without knowing they asked if they could search my car and I said sure. Well my friend had left his pipe in my glove box and i got the possession of drug paraphernalia ticket. My question is can i use the information above and plea not guilty at court or what actions should i take at court?

    Why did he put his paraphernalia in your glove compartment, and why weren't you aware he did so? He's going to back you up in this story?

    Even if your buddy gets on the witness stand and (after being informed of his Fifth Amendment rights, because he would be confessing to a crime) says, "I put my pipe in his glove box when his back was turned," the story may not be believed by the prosecutor, judge, or a jury.

    Depending on your record, you can talk to your lawyer about whether you might qualify for a deferral or "first offense" disposition that would allow you to avoid a criminal conviction. You can also discuss your chances of prevailing if you go to trial, with or without the testimony of your buddy.

    Sure you can plead not guilty. You have less than a 1% chance of your story making a difference. You should pick your friends more carefully. I suggest you hire a lawyer.
