I live in MD. During the storm, a tree in my backyard split in the middle. It was in bad shape and needed to be cut down. It is on the so-called protected area (basically I cannot do anything to this part of land) and I was told that I cannot cut down any trees and have to get it approved first if I want any tree removed.
So I called HOA on Monday morning to get it approved. I was surprised that HOA said it was on their property so they would cut it down at their cost. I told them that if I was going to be charged for this, please let me know first before cutting it down because I could find someone cheaper. HOA said tree guy knows the property very well and he would take care of it.
HOA sent tree guy Monday night and tree guy said he would take care of it and I told him again if I was to be billed, don't do it and let me know first. HOA called me again Monday night confirming it with me and tree guy called too. On Tuesday the tree was gone.
A week passed. This Monday, I got a call from HOA saying tree guy made a mistake and it was on my property and I have to pay the $2000 bill. I told them no I never authorized anyone to cut it down if I have to pay for it because I can find someone cheaper and I never called the tree guy myself to come over there. It now seems that HOA is not going to pay the guy and the guy is going to bill me for this.
By the way, I didn't sign anything and HOA cut down dead trees in the same area a few yards from this tree at their cost. Do I have to go to court for this? The issue is if HOA and tree guy made a mistake they should be responsible for this instead of throwing the $2000 bill at me. I am worried about HOA putting a lien or the tree guy sending the bill to collection. Should I go to court and sue both of them if I receive a bill?
