My question involves a child custody case from the State of: Texas.
The court ordered supervised visitations, that has been going on for the past 2 years. I want custody and unsupervised vistations. The reason they are willing to give custody is my legal status. I am an illegal immigrant. I have gone thru background check, drug test, psychologial exam and they are all clean. I am a quite person, shy and timid. The kids were taken away by CPS because the mom was intoxicated at the WIC office and accused of doing drugs. Which turned out to be true. The original reason they were not given to me was because I did not speak up and they accused me of doing the same things she did. After all the exams, I proof I do not do drugs or alcohol or anything that endagers my kids. They are two kids, a boy and a girl, but one is not mine. My daughter is now 5 yars old. The case started in 2008. I keep asking for custody and I am told no because I am illegal immigrant. The mother has had to go to drug rehab, The kids live with their maternal great aunt. I can only see my daughter every other week at a SAFE Center. How can I ask for unsupervised visitation and/or custody. Is being an illegal immigrant a reason to not have my daughter.
