    Default Ticketed for Using Commuter Train Without a Valid Pass, Missed Court Date

    I wasn't sure which section this question should have been posted to. I commute via our mass transit (Sacramento Regional Transit Train). You're suppose to buy a pass in order to board the

    train. I didn't buy one - I was running late and just boarded without getting the fare. It happened to be on a train where the RT authority was also riding the train. They do random checks for

    passes and I didn't have one. So I was ticketed. I accepted it and knew I had screwed up. I put the ticket in my bag and figured I would wait for something in the mail. The duplicate copy was

    very light. So I had forgotten all about it. I just received a letter - Warrant for my Arrest just today. The letter basically said that I have a bail $425 and can avoid arrest by paying the bail or

    going to court. I know I did wrong with the fare evasion but honestly forgot about the court date.


    Obviously I want to pay the bail but I can't afford to pay that full amount at once. When I go to court, do I just ask the judge for payment arrangements? Can I just pay the original fine for not

    paying the fare? I know there's no excuse for my fare issue but it was my only one - first one. What should I do? I do plan to go to the court house Monday morning.

    Absent payment in full, no one can guarantee the judges response. That said, my understanding is that courts tend to accept a payment schedule if you have a down payment and follow the schedule.

    The bail is money you pay to ensure that you will appear in court. If you don't pay the bail, the bench warrant will remain active.

    If you go before the court without your bail money, I suggest taking your toothbrush with you. Although it's possible that if you go before the judge and indicate that you can pay $X today and pay the rest in monthly payments of $Y, the court will accept that, it's also possible that the court will remand you to custody pending a hearing.

    It's too late to simply pay the fine and make this go away - the warrant must be withdrawn.

    If it were me, I would sell some stuff, borrow money from family or friends, etc., and get the amount paid off.
