Default Re: Can You Get Drunk Driving Probation Transferred to Another State

    1. got my DUI after i got my CA license. MI didn't "recognize" my CA license so they charged my old MI license since that was still in their system
    2. I handed the cop my CA license which he confiscated which he shouldn't have. so, a week later i got it back from him.
    3. i still have my CA license
    4. My MI driving privileges are still restricted for another 3 months
    5. I did NOT have to give up my MI id when i got my CA id. they just punched a hole into the expiration date of my MI id
    6. NO, since MI doesn't have me in their system as a CA driver. MI thinks i'm still a MI driver even though the cop wrote in my report that i was a CA driver.
    7. i was never denied to move back to CA. I live in CA, just vacationed in MI. I'm in CA now.

its NOW certain that MI will keep me on probation. whether or not its legit is beyond me. I have to report back to them every month via email/fax. I'm pretty sure CA will never find out about this because MI has me in their system as a MI driver. as far as i know its not my probation officer's responsibility to report this to any outside sources/agencies. i believe thats the responsibility of MI Secretary of State(DMV). the way i see it, the only way CA will find out about my DUI is if CA searches through a national reporting agency. and that's if MI reports it to the national agency. and by that time my probation will probably be over and my driving restrictions would be ancient history.

what could happen if CA finds out about it AFTER i'm a "free" man?

I would go ahead and consult with a CA Attorney and he could check for you but he could be good in case CA DMV finds out and takes action at a later time. Basically know your options are in case you get the dreaded letter from the CA DMV. You will want to ensure that CA DMV has your correct address just in case. At least the good thing is you are not dealing through CA probation as a surrogate to MI probation. You will want a good CA Attorney who specializes in DUI's and DMV matters. On your MI privileges being restricted for another three months, more than likely you will be listed in the NDR/PDPS as suspended until you get your full privileges back and afterward, be listed as reinstated. The only CA would find out is if they search on you in the NDR/PDPS. If there are any reinstatement fees that need to be paid, get those taken care of or any other hoops that you may need to be done before the date you can fully reinstate your license.
