    Default Hit a Car, its Owner Got it Repaired Before My Insurance Inspected the Damage

    My question involves a traffic accident in the State of: Indiana


    This week, I was in an accident in which I slightly dented the drivers side door of the car on my right hand side as I was backing out of a dark parking lot. The car was parked on the white line closest to me and was very close in an otherwise empty parking lot. I still recognize I was technically at fault.

    I waited till the driver came to her car and told her what happened. I am 25 and my car is under a group insurance plan with my family. The lady asked me odd questions like where I lived and what my parents did for a living. Only hours later, she took her car to a repair shop that day and had her insurance call my mother (instead of contacting my insurance). We wanted to possibly settle without insurance but they claimed the damages were over $2200 and wanted $500 for a rental car for a week (her car was a pt cruiser). They then claimed the repairs might be more once they got started.

    My family and I discussed the scenario. An hour later, we called their insurance company back and told them we would let insurance handle it since the estimate was very large (and we suspected the estimate's validity). They proceed to tell us the car is already being repaired. Keep in mind our insurance company has not been able to take pictures of the car, give an estimate, etc. Doesn't this violate a condition of our insurance paying out a claim? Regardless of what the damage was, it seems fishy that they got repairs before our insurance could inspect the car or see it at all.

    There was no police report nor any photos taken at the accident scene.

    You presumably have a duty to your insurance company to report the accident in a timely manner. We do not know whether or not you complied with that requirement. If the owner of the car you hit had your insurance information, one would expect that their insurance company has already been in touch with yours about the claim and possible subrogation. They don't have any duty to your insurance company when they're obtaining repairs through their own insurance.
