My question involves criminal law for the state of: Tennessee
I am 18 years old, a freshman in college, and live in Tennessee. I have never been charged with anything. I went to a concert in downtown Nashville, and me and my friends were smoking marijuana inside the car in a gravel parking lot outside of a venue. Three undercover Police walked up to the window and asked us to get out of the car. They observed me putting 4 grams of marijuana in a small pocket in the car. I was the only person in the car charged with possession of marijuana but we all got charged with paraphernalia (a grinder and a pipe).
One citation is for Simple Possession and it states: 'Defendant was observed in the above vehicle (parked) which was emitting a strong odor of marijuana. The defendant was observed removing a small bag (approx. 4 gs) of marijuana from his lap area and placing it in the rear 'map pocket' of the driver seat. The defendant had no warrants and no history of FiA/FiB.'
One citation is for Drug Paraphernalia-Unlawful Use and it states: 'Defendant was an occupant of the above parked vehicle which was emitting a strong odor of marijuana. PC search of vehicle led to recovery of a metal grinder w/ marijuana residue and a glass "one hitter" pipe both in the back seat area where the defendant was sitting. The defendant had no warrants and no history of FiA/FiB.'
I was put in a cop car for 2 hours while they wrote my citation and then they let me go without going to the police station. I have a court date in like 20 days back in nashville. If anyone knows the likely outcome of a situation like this for a previously clean 18 year old male, help would be appreciated.
