    Default Public Intoxication Charge Against a 20-Year-Old

    My question involves criminal law for the state of: public intoxication
    Hello, I am a college student and was arrested last night for public intoxication. I feel my drink might have been spiked at a party i was at. I was fine and then next thing i know i woke up in jail. No recollection of what happened. Also I am only 20. I was charged with a 647 (f). What should I do? Any chance of getting it reduced with some sort of AA program?

    state means something like Georgia, Alabama, Texas, or any of the 47 other states.




    and I am sure the courts have heard the "my drink was spiked" so many times before. Unless you have proof, I suspect it will be quickly dismissed as a defense.

    Some counties do not charge for this and you may get lucky and suffer no penalty at all. You might also have a chance at diversion through counseling and abstaining from alcohol. Perhaps now is a time to top partying and drinking. Next time you may not be so lucky as to wake up in jail ... you might not wake up at all.

    Common sense tips for going out:

    - Never ever take your eye off your drink
    - Gotta go to the bathroom? Take your drink with you (into the stall), or finish it before you go to the bathroom.
    - Stranger sends you over a drink? No thank you.

    Height and weight are great, but public intoxication does not require a specific BAC and one can even be perfectly fine to drive and still act in a way that could get him or her arrested for public intoxication.

    That's nice. Laws differ by State in the Union, which is why we ask.

    That MIGHT help, but don't expect that it will for sure. You're awfully lucky that you only got charged with public intox, and not MIP on top of it.

    And to backtrack a little:

    A word of advice from a professional wino: NEVER drink with people you don't know. That means if you're at a party where you do not know 100% of the people there, and would not crawl through broken glass for 100% of the people there, don't drink. Save your drinking for the privacy of your own home, with people you absolutely trust. I know, it sounds stodgy and dumb, but given the number of people who show up in the ER every year because they got roofied? Seriously, so much safer. Plus, no public intox or MIP charges, and if you puke on the dog, who is she going to tell?

    but what was meant by the question was to name your US state so the laws of your actual state can be utilized when providing a response.

    I'm same height but considerable heavier. I get a buzz from a single beer so bad I couldn't safely drive.

    well, my dad always said to look for things to add to my resume. I don't think he was talking about something like this.

    California. Orange County to be exact. The charge is 647 (F) PC DISORD CONDUCT: INTOX ALCO
