My question involves a child custody case from the State of: Colorado
First I would like to say Thank you for any advice anyone has to offer! Monday I have an appointment with my Family Lawyer but, I just can't wait.
So here is the problem I have a 3 year old son who goes to see his father (my ex husband) every other weekend and on different holidays per the court order. Recently the Father moved to the same city as us and has begun to start a new job and new family wit h his fiancee. I am genuinely happy for my Ex as he is a great father to our son unfortunately, in the past 6 months since he meet his fiancee and got a new job we have had issue after issue.
His new job requires him the work 13 hour days Fri, Sat and Sun. For the past 3 months everytime I go to drop off our son no one is home. I wait between 1-2hrs to see if someone comes home but, eventually we leave. I am more than willing to work with my Ex because I want him to see his son but, I'm tired of having to change our schedules to fit his. I let him know that even though he is supposed to be there per our custody agreement I'm more than willing to drop our son off with his fiancee while he's at work. But, everytime I set something up with her she calls 30min before I'm suppose to drop him off to change the plan.
Over the past 2 months I have begun to record whenever he isn't home, how many times I drive over there a weekend with no answer, phone records for all the phone calls, emails where he claims he/she will be home etc.. Well today I received an email from the Fiancee letting me know that I am violating the custody agreement and that they intend to file in contempt of court order and for full custody. I am absolutely terrified! I just didn't want to drop my son off at a house with no one home!
So after all that my question is am I breaking the agreement? Could I lose my son? And if the Father does the same thing of not being home tomorrow when I go to drop my son off what do I do??
