    Default Entering the U.S. with Green Card After 5 Years Out of Country

    If a person has a green card and enters the US (from the UK) after a 5 year absence, I have 2 questions: 1) What should they expect from immigration? 2) How can they continue to use the green card to travel in and out of the county in the future? (I'm concerned that they have been out of the county for too long)

    Details:
    Green card issued in the 80's (no expiration date)
    Person files US taxes each year
    Person maintains US bank accounts.
    Person has family members that are US citizens.
    They left the US due to the death of their spouse.

    They should expect to be told that they are no longer a permanent resident and need to enter under VWP or a visa.

    They can expect that they will have to start the process of getting a Green Card all over again, assuming they're eligible.

    Yes, almost certainly they will be handed an I-407 on entry. If you want to make sure that you can come in, you better have a Visa or VWP. Five years is definitely two long. There are things that could have been done to preserve residency (returning periodically, applying for reentry permits) but at this point you'll probably need to start over.
