    Default Character Illustration Usage

    Hello,

I am new to this forum so thanks for taking the time to look at this post. I created an illustration about 5 years ago for a local publication and never signed over any rights. They have been printing this character annually for the 5 years and re-creating it in different forms (T-Shirts, Sculptures, 3d Computer Models, etc.) All have been great for exposure, but the usage wasn't disclosed when this was originally created and the compensation surely doesn't match the amount of times this character has been reproduced. Recently the character was used in an illustration that I did not create and is a poor representation of my skills. My question is "Is it worth my time and money to hire a lawyer to negotiate rights to this character? Or should I just let this one slide?" Once again, thanks for your time.

Are you sure you didn't sign anything over? Was there a written contract? Any emails or other writings discussing the issue? Why have you sat on the issue for 5 years? There isn't enough information here to give a good answer other than to talk to a lawyer or two and tell them all the relevant facts to see if you have a good case or not.

Did you enter a contest that you submitted your illustration to, for say, something like a prize or $100?

If so, you need to read the fine print as you may have waived your rights by entering and submitting your artwork in the contest.

How many times have you "just let it slide"?
