    Default Can Unsafe Parking Areas in an Apartment Complex Be a Legal Reason to Break a Lease

    My question involves landlord-tenant law in the State of: Nevada

    I've been living in my apartment now for over a year, and I didn't have any issues till about 4 months ago; after I had signed my second 1-year lease. My issues began with my car being broken into several times. The apartment complex is gated, but the gates are always open, because they seem broken 99% of the time, and security is very lazy; so there is no one to watch or monitor the premises. I've filed police reports and complaints to the management, but nothing has been done in the last four months to stop people from just walking up and breaking into my car. So I'm constantly worried about my car being safe on the property. I have installed an alarm system into my car, as well as a lock for my steering wheel, because I'm fearful of someone stealing my car.

    I also have issues with the upstairs neighbors throwing trash onto my patio. They toss q-tips, cigarette butts, and plastic onto my patio. I have small animals that I used to let out to the patio to get fresh air and play, but now I can't because I fear that they might eat something and get sick or choke. I've taken my patio furniture off my patio, because again, I get this trash on my patio. I've made complaints several times about it, but nothing is done.

    So I'm trying to find out if my reasons are good enough to give me the right to break my lease and leave, without too much penalty fees or legal action being taken against me. Any help will help me out a lot.

    You lived in the complex for a year without issue, then in the space of a few months your car was broken into several times? Just your car? The thief is breaking into every car in the lot, or are you the specific target? What has been taken?

    Also new in the last four months? Do you have any evidence that the person or people who have broken into your car are coming from outside of the community?

    What do you mean, "security is very lazy"? There are security guards on site, but they don't patrol?

    Can you better explain the mechanism here? They live directly above you? You say "throwing" - are you saying they're deliberately targeting you with their garbage? Why?

    Nobody ever spoke with the other tenant, or gave them any sort of written notice of the complaint?

    As a general rule, your landlord is not going to be responsible when somebody breaks into your car in an apartment parking lot. As a general rule, having your neighbor be obnoxious is not going to get you out of a lease. The rest depends on the details.
