    Question Got a Second Job when I Found Out a Lay-Off Was Coming - Can I Quit

    My question involves unemployment benefits for the state of Hawaii, County of Hawaii


    The company I have worked at for the past two years is shutting down on October 31st. I tried to secure another job in advance, and have been working my primary days off at the new job for the past three weeks.

    The new job just is not working out with my families schedule. I have to leave for work at 7am and my wife has to get up with the babies after only getting a few hours of sleep. (We are both bartenders/servers - she does not get home until 4am regularly.)

    Anyway, I did not want to ride out the UI, but now I'm starting to think I should not have just jumped on the first part time opening and waited for something better?

    If I quit the new job that I have been at for less than a month, and then get laid off on October 31st from my primary job, how does that effect my eligibility for benefits?

    You'll have a much easier time quitting now than if you wait until after you get laid off from the other job.

    Be sure you really want to do this because if the UI people find out that you quit knowing that you'd get laid off from your other job, you'll end up with no part-time job, no primary job, and no UI benefits.

    Does HI have any laws regarding partial unemployment? I was making $16hr+ tips/benefits/vacation etc. working for a resort. Now I'm at minium, no benefits, making literally 1/4 of what I was.
    Other bartenders where I was have already filed for UI and have been quoted nearly max ($480/wk) - Currently I'm only making about $120 hours+tips/wk at the new place. Do I lose out because I was trying to set up something else? I'm not trying to milk the system, but I have kids and need to make sure I do what is right by them, now I am in a situation where it looks like taking a part time job in advance of the layoff was a HUGE mistake.
