    Default Unemployment Benefit for 'Mutually Agreed Dismissal'

    My question involves unemployment benefits for the state of: NY

    Hello,
    I was recently laid off due to a merger and the employer and I decided upon a mutually agreed date (two weeks) by when all the knowledge transfer would be complete to the person who is taking over my job.

    I would be filing for unemployment.

    Can anyone suggest me what to put in the reason for unemployment on the website? I dont want to be put in a condition that the employer denies my claim and says that we didnt terminate you, you resigned.

    If the employer is going to say you resigned, he's going to say it regardless of what you put down. There is nothing you can list that is going to PREVENT him from claiming you resigned, if that is indeed his intent.

    The correct term for what happened to you is Reduction in Force.

    thanks for the response. I am certain that I have the rights, but am being very cautious.

    We decided upon the date looking at the calendar on his wall -- all I asked for three days in advance bacause I had a vacation planned - this was all verbal. I am concerned that he might use this to state that I resigned and the departure was amicable.

    I understand that you are concerned that he might state you have resigned. If that is indeed his intent, nothing either you or I can say is going to prevent him from saying so.

    IF he does, then you truthfully respond to the questions that the UI office asks you to the best of your ability. There is no magic answer I or anyone else can give you that will guarantee that your boss will not claim you resigned or that you are guaranteed to prevail if he does.
