    Default Consequences of Granting Temporary Custody to a Third Party

    My question involves a child custody case from the State of: Ohio
    I recently signed a paper to temporarily sign my rights over to my dad's girlfriend. Now she is trying to keep her from me and thinks that she is calling all the shots. I want to get my daughter back, but I don't know how to go about it.

    You need to explain exactly what "temporarily sign my rights over to my dad's girlfriend" means, and exactly how that was done.

    Okay, my dad kicked my daughter and I out. I moved in with my friend and knew that without more hours at work and getting things handled I wouldn't be able to take care of her. So I let her take her because I knew she would be taken care of there. She then met me for lunch and brought papers with her for temporary guardianship, and I signed them trusting that when I was on my feet I would be able to get my daughter back. Now, 2 weeks later she doesn't want me or her father to see her. I contacted 4 different courthouses in our area and they have no record of my daughters name, and I believe this means no judge has signed off on it and it is technically not legal. I want to just go get her, but I also don't want to have to deal with the police if she so happens to call them on me.

    Again, you need to tell us exactly what happened. Telling us, that you signed "papers... for temporary guardianship", does not inform us of whether this is some form of informal grant, or if you consented to her appointment as guardian by a court. You seem to be indicating that these were legal documents to be filed with a court; but the fact that you call random courts doesn't inform us either that you're calling the correct courts or the correct clerks' offices within any given court.

    How about this? You go to the police first. You explain the situation. You indicate that you find no evidence of any court action and that you have revoked any consent. You then ask if they will help you recover your daughter.

    What exactly did the papers say about the length of such guardianship?

    I suggest that you go and get your child. If the person doesn't allow you access, then you call the police and report the situation or let her call the police. Either way she is going to have to produce the paperwork that gives her guardianship. If it is legal, it will at least give you more information about what court signed the paperwork. If it's just home-done piece of paper, its not worth anything and you'll get your daughter.

    I agree, go get your kid. If she protests, call the police and make her prove up.
