My question involves restraining orders in the State of: Upstate NY
I am trying to file for a full order of protection against my daughter's father. He is considered homeless and jumps around from place to place at the moment, but still manages to show up at my house. I know in family court both parties are required to be in front of the judge. Is there any way I get bypass that since I don't have an address for him and I don't know where he is staying?? And yes I have asked him and he's usually so xanax'd up and delirious or won't tell me. And besides the fact I don't want to see him nor talk to him in any way.
