    Default Misdemeanor on Record, Will This Hurt My Job Chances

    My question involves labor and employment law for the state of: Kentucky.

    I have been applying for jobs and all require a background check. My problem is I received a copy of my background check from one of the places and it says, F/M Record Found and it lists everything else as no record found. On the record that came up it says, that the charge was "attempt- failure to report change in benefits" and that the level is a misdemeanor and the disposition is guilty. It also states that there was a jail term of 180 days and 2 years probation but that the 180 days of jail time was conditionally discharged. This happened back in June of 2007.

    I was receiving food stamps and was in the process of re-applying for benefits and had given my current caseworker the documentation needed; in the middle of that, I was assigned a new caseworker and my previous caseworker didnt forward all the documentation to her. I recieved paperwork stating that I had failed to report a change in my benefits and had to pay several thousand dollars back that I was apparently overpaid or wasnt entitled too. I called the offices (main ones in Frankfort) and worked out payment arrangements on my own freewill. I was never told I had to but did because it was the right thing to do. In the end I paid over 2 years time all the monies back and closed my case to receive food stamps. I have documentation of that. In the meantime, I had a court date for all of this and a public defender and was charged with a misdemeanor from a Class D Felony. I served no jail time and I had no probation officer either. I walked out of the courthouse free like I had walked in... so I'm confused where all this jail/probation comes in on my record. Also, with it just saying I failed to report a change in benefits makes it sound not as bad as some peoples does, even though I know it makes no difference in terms of offense.

    My question is, will this hold me back from obtaining employment? Will this always be on my record or will it disappear after so many years? Should I disclose this information on my applications?

    When you commit a crime and a prospective employer finds out about it, yes, it can affect your job prospects. You are describing an offense involving both honesty and money, so it's something a lot of employers can relate directly to job duties.

    Odds are you were given a suspended sentence, consistent with what is described on your record.

    Consider petitioning for expungement.
