My question involves labor and employment law for the state of: Indiana

I was involved in an incident along with two other RN co-workers. I was terminated and the other female RN was terminated but the male RN was not. This occurred about two and half years ago but I feel that is discrimination case.

Here is the situation: Me, Katie and Jeff all worked as RNs at the same hospital and we are all social outside of work. Jeff and I worked on the mobile intensive care unit, a transport ambulance and Katie was charge RN in ER. I worked at a remote station, about 50 miles from hospital that employed us, that was used only to station an ambulance, supplies and the lounge area for crew. The ambulance crew Jeff was assigned to was stationed at the hospital and Katie worked at hospital. My station is located in the town that Katie grew up in and lived near at the time. Katie and I were roommates several months before the incident and had been friends for years. Jeff was the drummer in a band and Katie helped the band get a gig at a bar in the town she lived and I worked. The night that Jeff's band played at the bar I worked a 12 hour day shift ( either 6 am-6pm or 7 am- 7 pm) but had an ambulance transfer that made me get off work late. After work I went home immediately. While at home I got a call from Katie on my personal cell phone asking if I was coming out? I told her I was staying home that night. She then explained that Jeff who playing a gig at the bar (Katie is long time family friends with owner of bar) but we was feeling Ill and thought he was passing a kidney stone which he has a history of. Being we are RNs with emergency room experience we know the standard treatment for kidney stone is IV fluids and if needed nausea and pain medication. She asked which RN, paramedic and EMT was working the night shift at the ambulance station which is located about 1-2 miles from bar where Jeff was playing. I told her the names of RN and EMT ( no paramedic on duty that night). She explained that Jeff needed IV fluids to help pass the kidney stone, which means he needed an IV. So Katie asked if the crew on duty would be willing to give the supplies needed to place an IV and administer IV fluids to Jeff. I said probably but Katie did not have an established relationship with either of them so I called the station and explained that Jeff was passing a stone and needed IV fluids so he could finish the gig and that Katie was coming to station to get supplies. The RN was a newer employee so I asked the EMt if he thought the RN would allow Katie to get supplies. He said he she be ok with it do I spoke with the RN, Karen, explained the situation and she agreed to give Katie the supplies. So I called Katie and said Karen would help her get supplies. Katie then drove to station where Karen had to unlock supply Room to obtain supplies which she willing did. Katie then took supplies back to bar and during intermission of bands gig Katie place an IV in Jeff and administer a liter of normal saline. Another RN who worked in ER with Katie and was at bar to see band gave Jeff one of her prescription nausea medication pills to relieve his nausea so he could play remaining sets. After one Liter of fluids Jeff's pain and symptoms were not relieved (which as RNs they not surprised because in the ER patients with a kidney stone often require multiple liters of IV fluid) so Jeff decided to leave the IV in place and saline lock it in case he needed more IV fluids after gig. But Katie only had one liter of fluids. Jeff finished the remaining two sets without any concerns or problems. After the gig Jeff said he still didn't feel well and needed to go to local ER for further treatment. Jeff Katie and several other co-workers went to local ER (not hospital were worked for). Upon arrival to ER Jeff still had IV site that Katie placed and the RN (andy) providing care to Jeff is an acquaintance of Jeff Katie and other co-workers. So Andy knew Jeff worked for mobile intensive care unit ambulance and Andy assumed that the ambulance stationed down the road placed Jeff's IV because Andy knew it was the owned by the same hospital just different location. A report was made to the hospital that we work for that our ambulance went to bar and placed Jeff's iv. This was not true and was proven by the GPS tracker in the ambulance. So after gathering information from everyone involved our employer concluded that Katie was given supplies from ambulance station by Karen and Katie placed and IV and administered IV fluids to Jeff who also took a prescription medication, not prescribed to him, from another RN. Jeff finished his the second half of the gig and went to local ER with the IV still in place but he claimed he was too sick to know what was going on. ?? But he was able to finish two more sets of drumming rock music without incident?? I was responsible and truthful about calling station to tell Karen that Katie was coming to get supplies and her intention with the supplies. Katie and I were the only two who were terminated. I never saw any of these people involved except Karen and the EMT who were at the station when we arrived back at station from our transfer. I was at home when the whole incident occurred. I can't even honestly state any this happened except from I was told because I was at home and did not witness anything except the cal, I made to Karen. Jeff was not fired because he claims he was too sick but was still able to keep a beat? I was fired because they said I assisted in the theft of hospital property. But Karen who actually unlocked the supply room and gathered the supplies knowing the intended use was not disciplined nor was the EMT who was at the station when this happen nor was the RN who gave Jeff the prescription medication. Ultimately they held Katie Jeff and responsible for the entire chain of events but only fired Katie and me.

I was denied unemployment due to breaking hospital policy by assisting in the theft of property. I got a job very quickly and did not appeal the denial of unemployment. I feel that my involvement in this incident was not as crucial and unlawful as Karen Katie or Jeff and is unfair that my punishment was more sever than the punishment of Jeff and Karen and the RN who gave Jeff the prescription medication. I now have an employment record that reads "no Rehire" which I have to explain when applying other jobs.

Do you feel that I this may be a discrimation by sex or an unfair punishment for the crime? Do I have a ligamate case to have my employment record cleared?
