My question involves landlord-tenant law in the State of: Arizona
My parents who are elderly rented an apartment. My nephew accidentally spilled juice and it left a small pink stain on the carpet. My mom tried to get it out but could not. Upon moving out, the landlord did not do a walk-through of the apartment. My parents figured they would lose the security deposit because of the stain. But instead, the landlord not only kept the security deposit, but sent them a letter demanding over $700 more to replace the carpet in the entire apartment for normal wear and tear. The company also said that if they don't pay it they will take them to small claims court. My dad, who is 83 was so upset that he has made a payment of $196 to them already. My mom talked to the district manager and told them that she was the only one in the apartment during the day and the wear and tear could not have been that excessive because she is a very neat housekeeper and spent most of the time in the living room and kitchen. The reply was that the apartment manager did not do her job properly but they are still holding them libel for the charges. They are struggling to make the payments. Is there anything more we can do to stop this action by this apartment complex? Thank you.
