    Default Probation Almost Over and Got Caught Driving on a Suspended License

    My question involves criminal law for the state of: Pennsylvania
    I was convicted of theft 5 years ago. Spend a little time in jail. More in a halfway house. Have been incident free since. My probation is up in November, but I just got pulled over for driving on a suspended license. Any idea what will happen? Am I looking at jail time, if so, how much.

    Only your probation officer can answer that. It is possible they will violate you.

    Well, driving on a suspended license is a criminal offense and will almost assuredly be a violation of your probation. Also, your license was suspended for a reason. So, your statement that you have been "incident free" does not ring entirely true. Now, what effect that will have on your probation will be up to your PO and the judge. Have you reported the fresh arrest to your PO yet? If not, it looks better if you report it to him/her yourself rather than have him/her find out on their own...and he/she will find out.

    Ok, guess I should be completely honest here. I am actually writing because my husband is the one in trouble, not me. I am so clueless about any of this stuff. I myself, thank God, have never been in any trouble with the law (with the exception of an occasional speeding ticket). So, let me start over and give you the entire story (because I have found out so much more in the last 48 hours).
    My husband was arrested for theft from his job in 2006. Spent a little time in jail and then the halfway house. Is he on parole or probation? I was told parole because he didn't serve his entire sentence.
    His license was suspended for being in arrears on child support. I didn't know about this until we tried to renew his license. He hasn't actually been pulled over for driving on the suspended license, either. I am seriously thinking about turning him in though. Concerned about my vehicle though. Will they impound it? We only have one vehicle.
    I just found out, through searching court documents, that because of the theft arrest he has over $67,000 in restitution to pay. He has paid nothing at all towards this in 6 years. He also has not paid any of his supervision fees which are $600.
    His probation is up next month.
    I am really looking to find out what is going to happen to him. Honestly, at this moment, I don't care if he goes back to jail. He was not honest with me about 99% of this situation. I also do not want to be held responsible for his mistakes. I really should have done a background check before we got married. (We have only been married for a little over a year.)
    Any advice that I can get I really appreciate. I'm treading on very unfamiliar ground here.

    It sounds probable that he is on parole. But, probation is possible too. Although I don't think it makes much difference in regards to your questions.

    While you can report his behavior, it is unlikely that the police will take any action unless they actually catch him driving. They likely cannot actually arrest him unless they catch him in the act. While the police could forward your complaint to the prosecutor for consideration of charges, your statement alone is unlikely to be enough evidence to move forward.

    If the police do catch him in the act of driving on a suspended license, then it is VERY likely that the car will be impounded. If you are on the registration, you could retrieve the vehicle...but, it is not going to be cheap.

    No, his probation is NOT going to be up next month. Whether probation or parole, if he has made no effort to repay court ordered restitution and has also failed to comply with his conditions regarding lawful behavior (pay child support) and payment of fees, I do not see him being released. Release from probation or parole is not automatic when the clock runs out. He has to be released by the court...and, if he is not in compliance with his requirements, the court can simply refuse to release him.

    My advice would be to distance yourself from him, especially financially, as soon as possible. I don't know if Penn. is a community property state or not. But, you need to separate your assets (like the car, money in the bank, credit cards, etc.) from his control to whatever extent you legally can. It sounds like you are preparing to dump him...and I cannot argue with that intention.
