    Default H-1 visa and Self-Sponsorship

    Hi,

    I am a Canadian student in the US and about to finish my Doctor of Chiropractic Studies.
    What I was wondering about is can I qualify for H-1 visa if I want to work in my own clinic or do I need to work for an American Employer in order to be able to get an H-1 visa?

    I guess it's theoretically possible to set up a business entity, have it apply for alien labor certification, then immigrate as an employee of that business, but... I wouldn't count on it working (that is, I would expect the USCIS to regard it as a sham), and if you were to wish to try that I would suggest working with an immigration lawyer on the details. (Also, what would you do if a qualified doctor who is either a U.S. citizen or permanent resident applied for the position you are trying to create for yourself?)
