    Default What to do after a vehicle is repoed

    .ooppppppsssssss i ment 1,300.and i have 1,100.sorry about the typo.............................................. oh and i forgot to add the bankruptcy i am going through(filed in oct) is the one where the house mortgage and the van are put together into one payment and i still get to keep the van. well then why isn't 1,100. cash good enough to get the van back and do i have to have it back in order to put it into the bankruptcy? i am a single mother and this mess is really got me frazziled big time.

    oh any why are they waiting for a condition report bak on my van? what's this for? what factor does this do or change?

    and do i have to have the van back before it can be put into the bankruptcy?i don't know what i can an cannot do?

    You can include your obligation relating to the van in your bankruptcy.

    You defaulted on your loan. That means you don't get to dictate the terms to get your van back. You need to contact your lender, find out what they are demanding, and try to negotiate to the extent that they'll let you.

    what bearing does the condition report have on all this. cause when i call they keep telling me they are waiting on this report first?

    They're probably determining the value of the car to determine what course of action is in their best interest. If they keep it and sell it at auction, and you discharge the balance in bankruptcy, they may take a significantly larger loss than if they let you recover the car after paying a certain amount, or if they sell you the car for an amount less than the total balance owed.

    lawyer gave me the release papers to go get van. said i would have to give the $1,100. i have so i turned it into a money gram and grammed it to auto people. but there is still a bal. of $675.00 in repo fees and such so we got them to accept the 1,100. and put the rest in a 50.00 more a month auto payment. now the kicker. the place holding the van will not release the van. my son came over to pick me up to go to the place holding the van. we drove 1 and1/2 hours to this place and they would not answer door and phone and we had an appt. so we tried again the next day. same thing. so we spoke to car lot next door they said this place is famous for doing this because they get more money in fees the longer they have to keep. the lot next door says we are not the first ones they did this to. is there any way to stop this place and make them hand over the van? i have the release papers.

    oh and by the way the van place doesn't know we intend to put this van in out home bankrupcy.

    oops sorry for the typo it's our/my not out. ok.

    i hated the van when i first got it. then i fell in love with it and so did my son and daughter.the $$$$ is already grammed to the van people cause the bankrupcy hasn't been filed yet. i am not starting over i am keeping the home/ranch and van by filing bankrupcy the lawyer is going to set it up to where i can make only one payment and be protect from the repo and mortgage company ever again. all my earning went in to this ranch and van i worked very very hard over the years to get here. why do you say screwed the lenders they screwed me. you are not being real nice in your wrong sayings. i think you don't know the whole picture. you totally misunderstood me nomorecrime or whatever your name is. wow peace be with you and your not knowing the what's going on.
