    Exclamation Sex Offender Laws and Halloween

    My question involves criminal law for the state of: Maryland

    What is the sex offender laws in the State of Maryland in relation to Halloween? From hearsay I have heard that sex offenders cannot leave their house on halloween and must post a sign on their door stating no candy.


    Can somebody point me to the specific actual legal defination of this law. The law statue, code number etc.

    It's under Maryland Statutes, Title 11, Subtitle 7, and is empowered under sections 11-708, 11-717, and 11-718. Notice it doesn't say anything about Halloween in particular, but they work under the umbrella that authorities can give notice to the public in any manner not otherwise restricted. As far as the not leaving the house part, the law doesn't specifically order that they can't leave the house on Halloween, but the law IS broad enough that with kids running all over the place, law enforcement would have grounds for arrest almost as soon as a registered offender showed their face.

    It is not actually codified specifically for Halloween. It is simply a restriction placed on sex offenders as a part of their registration. I don't know exactly how it works. If you are a concerned parent, contact local law enforcement for guidance. If you are a registered SO, contact your PO if you are still serving part of your sentence or local law enforcement if not.

    Also, it's a popular night for LE to visit all the SOs to make sure they are home and behaving themselves.

    Thanks for your response. Additionally, do you have information on Maryland General Order 08-010 where it restricts Sex Offenders travel to Ocean City and where can I find this?

    No such luck. The state has no lawful way to restrict travel to Ocean City or any other city for that matter. Worcester County, in fact, just got awarded a state grant from the governor's office to help with tracking and monitoring sex offenders, including the 21 of the county's 75 registered offenders who live in Ocean City.

    So there is no such thing a Maryland General Order 08-010?

    Additionally, the specific rule mentioned was any Sex Offender traveling to Ocean City must register with Ocean City Police Department before they go to any part of Ocean City.

    Having to register isn't the same thing as being restricted from traveling there at all. General orders are more often city or county level ordinances - not state statutes. The state doesn't set rules, regulations, or policies that get enforced at city/county levels - that's up to the particular city/county in question.     I cant even find anything relating to sex offenders in Worchester County Code

    Here in Indianapolis, probationers convicted of sex offenses are ordered to attend a mass group meeting on Halloween evening so they are not at home during trick or treating hours.
