    Default Bankruptcy and Joint Bank Account

    My question involves bankruptcy in the state of: Calif. I am my mother's caregiver, have Power of Attorney over her financial and health. On one of her accounts, I have used funds to make payments on my credit cards. Cards I've had to use at times to pay for food, phone, internet service, her insurance and expenses from before I became her caregiver. I've had to draw funds from her account to pay the bills. The account is a joint account with one of my sister's, who has also put money in it to help us. Would my drawing funds from that account be a problem in filing for bankruptcy? I have her approval to access the account.

    A problem in what respect?

    You mean, if you claim that none of the money in the account is yours but the trustee or creditors note the fact that you spend the money as if it's yours?

    You mean, if your relatives find out that you've been spending a lot more of your mother's money than they were aware of?

    Something else?

    My sister has given me access to the account and knows what's happening. It's a joint account between her and my mother. She has said to use it for whatever you need. Most of the recent charges (past few years) have been for the home, car repairs, food, insurance....things required to care for my mother.

    If it's your money as much as it is your mother's, you can expect the trustee and creditors to view it as your money.

    I have no problem with that, it's not alot of money, around $500 a month in the account. My concern was using the account for paying down my cards. But if it is a joint account with my sister and she has said to use if for whatever you need, there should be no problem about me accessing it? My name is not on the account.

    This is now a moot point....not filing for bankruptcy. Talked the issues over with my sister....it's her account.
