    Default Shoplifting, Resisted Detention by Security, Ran from Store

    My question involves criminal law for the state of: Texas, Harris County.

    Shoplifting in Texas.

    While fleeing a store with stolen merchandise (under $50) in my pants,
    a plain clothed security guard grabs my shirt by the collar,
    effectively halting me, I never touch him, but squirm and wiggle to get away...
    That proved futile, so, I take a step back, bend forward and loosen my arms,
    I'm attempting to shimmy out of my shirt, my attempt is successful, and I'm free.
    Now I am shirtless in front of the establishment, security holds in his hands, my T-shirt,
    without me in it... I run for my car, he watches from the front door like a statue, a statue with a
    Billabong T-shit in his hands. I abscond. The End.

    Other info: The security guard did not likely see my plates, but there were cameras in the
    parking lot. The one's that look like blow dryers, and the black half ball ones.

    What am I lookin at? A multi-track future lies ahead, many things could happen, maybe I don't get
    caught...the cameras didn't catch my plates... Maybe they did, am I going down for Robbery because
    I resisted detention by Security? Or Am I gettin off with simple shoplifting....

    Really? Offering morality advice is worse than being an unrepentant thief? Ok. If that is you attitude, you are not open to useful advice and I won't waste my time giving it. You are not worthy of help minimizing the consequences of your actions and deserve whatever happens to you and more. Have a nice life.

    My attorney buddy had this to say:
    "Sounds like shop lifting to me. Of course the store was within its rights to take reasonable steps to stop him for theft of property and I suppose they can argue the resistance constituted an assault."

    .....Which can escalate everything....But as a jury could see the nature of my flight on camera,
    it's unlikely the the prosecution could argue the security officer was genuinely afraid (which would constitute assault and robbery) of the pizza-faced little-linguini-limed-kid, that's me, shimmying out of his ironic hipster T-shirt... I posed no threat to him, and he knew it, the first and only thing the guy said to me "Come errrrr you little bitch", yeah... Have you
    ever been afraid of a "little bitch".... I haven't, nobody has, not no one, not never, not no how!

    Many times, security guards are off duty police officers. You could potentially be charged with resisting arrest or assault on an officer, in addition to theft. I would be very concerned they obtain your plate info and come after you. It may take a while to process the camera info as it will likely need to be transferred to a magnification/plate reader system, to be run for ownership info. It might be a good time to move.
