    Default Alimony and Food Stamps

    My question involves a marriage in the state of: Tennessee
    How do I go about finding out if my ex-spouse is receiving food stamps along with the $4,400. per month in alimony I'm paying? If it's confirmed and is fradulent, who do I report it to?

    Fraudulently receiving food stamps by not disclosing income is not a legal matter? The proof will be in the food stamp rolls.

    You don't. That information won't be disclosed to you. If a COURT wants to know that information, in conjunction with a court case where it might be relevant, the court can request that info.


    If it's confirmed and is fradulent, who do I report it to?
    If you suspect fraud, you report it - just call and say "hey, I'm paying thousands in in alimony and I think she's also collecting foodstamps". It's neither your job nor responsiblity to investigate or confirm fraud - that's the job of the agency. You also won't be notified of the findings of their investigation. If they uncover fraud, they'll take the appropriate action against her.

    There's absolutely nothing weird about presuming that the ex-spouse in question who might be gaming a system is female. It's still true that 98% of the time (yes, I'm pulling that stat out of my posterior), the support-receiving ex is female.

    I am faced with the same situation. I pay someone each month and they "work", the already broken Family Court system.

    Can't alimony be terminated based on the following:

    1) Fraud or committing a crime?
    2) Failing to become self-supportive. (i.e. Gavron Warning).
    3) Unreported income? (i.e. Working under the table.)

    What action can I do on my own to present this information to the court in order to get alimony removed?

    (For example, I will requesting for an evaluation of what income the other party should be making. They only work 10 hours a week. I will also ask to impute their income.)

    I would kindly like to know of any previous court decisions where any of these approaches has worked to lower or remove alimony.

    You ask her and see if she feels like telling you.

    Here's the thing: while child support is taxable to the payor, spousal support is taxable to the payee. If your ex- receives food stamps while receiving a disqualifying amount of spousal support (and I believe that the limit is $50, so you're way beyond that number), the state is going to find out.

    Perhaps they assumed you're male. You're in a state that does not permit gay marriage.

    Start your own thread, identify your state, and quote the relevant language from the support order.

    By hoping that the employees at the local food stamps office don't care about following confidentiality laws, enjoy the prospect of being sued, and want to lose their jobs.


    if you think she is recieving contact the fraud investigator at the social service office and provide them proof you have been paying her, if she is getting assistance and not reporting it they will nail her to the wall, either way you won't know about the outcome unless your support obligation ends due to her incarceration.
