    Default Collecting Back Child Support

    My question involves child support in the State of: Utah

    My ex and I made a verbal agreement when I moved to Colorado. We both agreed that he would not pay monthly support but that he would put the money away for our child's college and use the money for plane tickets when he wanted to see our son. Our son is now 21 and in his last year of college. I recently found out that my ex has not payed for my sons college since he was a sophmore. My son didn't want to tell me and I happened to find out by accident. I was wondering if there is any way that I will be able to either get him to pay for my sons college or if I can sue him for back support.

    No, I'm sorry.

    Your son has "aged out", and you cannot obtain an order for child support.

    This is why, for anyone else reading, you need to get child support court-ordered.

    I'm not sure I gave all the information correctly. My ex was ordered to pay child support in our divorce.

    did it include the father putting money in an account to be used for school? or to pay school in general?



    try explaining the situation a bit. I am guessing that maybe you allowed the father to forego child support payments in exchange for putting it in the bank.

    Realistically speaking you will need to consult a lawyer with the support order and the terms of whatever agreement you reached with the father about payment of support. Your lawyer can assess the timeliness and likelihood of success of an enforcement action, and advise you what the action is likely to cost vs. what is likely to be recovered. If you agreed to have support paid directly instead of going through a support agency, and then further agreed to the bank account arrangement, it becomes trickier to prove and enforce past support due to a lack of official accountings and the need to try to reconstruct payments many years after-the-fact. We have no dollar figures - it may be that your ex- did as agreed, but that the money ran out after two years of college.

    I AGREE!!!!! Nobody should 'think' their ex will do the honorable thing. Once you get divorced, get a court order of child support....it's to protect yourself and your kids. I am soooo glad I did!!!
