    Default Is the Admission Letter from a University a Contract

    My question involves education law in the State of: texas..

    on admission letter from my department, they said that they will pay my tuition and fee each term.. but for this term, they didn't pay it.. the senctence is "you are required to pay a tuition differential which the department will pay each term that you are enrolled in the program"

    do you think that they should pay this tuition and fee?? is this a contranct or not?

    On the basis of one isolated sentence taken out of context from a document we have not read, there's no possible way to tell. It's not even possible to tell, from that, if the admission letter is a contract or not.

    Take the ENTIRE letter, and any associated documentation, to an attorney in your state, and let him read the whole thing.

    Dear Mr. XXX;

    We are pleased to inform you that the Department of XXX has recommended to the Faculty of Graduate Studies your admission into M.Sc. Program in Electrcial engineering commencing September 1, 2011. The faculty of Graduate Studies will write to you separately to indicate whether or not the Dean has given you final approval. Please be advised that the Department of XXX is unable to offer any form of direct financial assistance for the duration of your program.

    Please be advised that the Department of XXX does not provide to you tuition support, travel, housing, or any other form of financial assistance – you are expected to be entirely self-funded for the duration of your program. However, as an international student you are required to pay a tuition differential which the department will pay each term that you are enrolled in the program.
    Please return the enclosed response by May 15, 2011. If no response is received by then, your position cannot be guaranteed. You can send your response by email to the Graduate Program Administrator

    The only thing this letter agrees to pay is the DIFFERENTIAL. It does NOT agree to pay your tuition or fees.

    i'm not sure whether this is a contract or not... does it have legal liability?

    A contract requires consideration. What have you given to the department, in exchange for their ongoing assistance?

    I would say it's crystal clear, to be honest. They specifically state they will NOT pay the tuition and fees - only the differential.

    It sounds like they are paying the differential between in state and out of state tuition.
