    Default Admission Despite Ground for Inadmissibility

    Alien was inadmissible due to previous unlawful presence. However, he was inspected and admitted anyway. Does this admission invalidate his ground for inadmissibility due to previous unlawful presence?

    Agreed.

    Just because he got in this time does not mean he will be able to keep returning without further problems. All it really means is that he got lucky.
