    Default How Do I Add My Husband's Name to My Daughter's Birth Certificate in California

    My question involves name change laws in the State of: California

    I would like to know how I can add my husband's name to my daughter's birth certificate? I was a single mom when I had her and I left the father's name field on the birth certificate blank and I gave her my last name. My daughter is almost 10 years old now and her biological dad has never been in the picture and has no desire to be. I am currently married to a man that has been with me since about the middle of my pregnancy with her and we would like to put him on the birth certificate and give her his name.

    Is there a simple way of doing this?

    sure; have him adopt the child

    I should've specified... Is there a simple way of doing this without going through the adoption process? Since the father's name field is blank can't we just request to have my husband's name added to it?

    If no father is listed and both parents will voluntarily sign the affadavit you can add a father and change the child's last name....see here: http://www.cdph.ca.gov/certlic/birth...-06-Merged.pdf

    the legal way is for husband to adopt the child.

    Since you were not married at the time of the birth, you will have to file a CS-909. On that there is a section where the father and mother sign that states he is the BIOLOGICAL father of the child.
