    Default Shoplifting Repercussions

    My question involves criminal law for the state of: TN/TX

    First off I want to say been browsing the site for months and there is tons of knowledge floating about.

    This is going to seem pretty complicated and has been driving me a bit nuts at the same time, but here goes.

    I was on vacation back in what used to be my home state (TN in 08' or 09') and me and a buddy went out and we ended up doing something stupid and getting caught. I get slapped with "theft under $500" charge, went to court did all of that got put on probation where I served about half of the probation, Circumstances had risen and I could not stay where I was staying any longer so I went back to TX. I had a physical address in TX but never actually became a resident until 2010 (even though i been living in TX for several years,) also while I was in TN i was also carrying a GA DL from my previous address. I went in for a job interview for one of the local courthouses recently to become a dispatcher and the hiring officer had told me that the case was "case deferred" and just left it at that.

    About half of the probation was completed, my community service was to get my GED, which I did here in TX (I'm even attending college too)
    I know for a fact there there is NO warrants out for me, I had been on a trip to TN earlier this year and got pulled over for a speeding violation if there was a warrant out for me then they would have bought me in on the spot. I know how TN is on some of there operations when it comes to things like that. The particular county I was staying in loves to hand out tickets and bring people into the station every chance possible.

    I'm wondering what can I do about this charge? It's preventing me from obtaining any real job. I'm tired of having this crap loom over my head for something stupid that I did when I was younger.

    Well shoplifting was stupid. Absconding from probation was stupid (especially if it was a deferral). You don't know for a fact anything. Just because a traffic stop didn't catch an out-of-state warrant doesn't mean none exists for you. You do know that for out-of-state residents probation transfers are just a matter of paperwork in most cases? You were stupid to abscond just because you needed to go HOME.

    To resolve this, you'll need to contact the probation department back in TN. It may be as simple as showing you've completed your probation conditions without further arrest or they may wish to pursue the violations. A lawyer wouldn't be inadvisable to help minimize the sanctions and perhaps the number of trips back to TN you will have to make.

    I dont think It would of been an out of state warrent, I was pulled over even in the same county in the same state where i had been arrested at to begin with. The thing was i had told my PO that i was going back and she said thats fine, i'll do the paperwork and give u a call. and never did call.
