    Default Problems with Re-Entry Due to Arrests

    Hello,

    I am a permanent resident and have had my green card for around 5 years. I have 3 arrests on my record for domestic violence; 2007, 2008 and 2012 (January). There were no charges because of the circumstances. The first 2 were with my ex-wife who was a little unstable. They were drunken arguments and she called the police on me to simply piss me off. But with the way the law is here the police “must” arrest someone regardless of what actually happened! The most recent one was another drunken argument with someone else. She smashed the front window and the patio door and like an idiot not thinking I called the cops as I didn’t know what to do to put an end to it. Once again I was arrested.

    Earlier this year we were driving back from Canada and immigration put me into secondary inspection and questioned me about my arrests and the outcome of them. They threatened me saying if they found out I’d been charged they’d start the deportation process. I reassured them that they would not find anything and they let me on my way. Like I said, there have never been any convictions/charges.

    We were hoping to go on vacation to Mexico this winter but I am now worried about re-entering the US. Is there something I can do so that these arrests are not seen by immigration and I am not flagged for secondary inspection? I find it stressful and upsetting to go through this whenever I re=enter the US.

    No, you cannot make your records disappear from the USCIS / ICE system. They have them on file, they'll keep them on file.

    You may want to get together documentation that can help you establish that no charges were ever filed. You wouldn't voluntarily give that to an immigration officer, but you might benefit from having a copy handy if the issue again arises. You can also discuss your situation in more detail with an immigration lawyer.
