My question involves a consumer law issue in the State of: Texas
Good Morning.
Back in March 2012 my son started Karate lessons. He had a great time and the people seemed nice. They set up a automatic withdrawl from our checking account for the $99 monthly fee. In June 2012 I told them we would be leaving soon because my son will be playing Football and practice times would conflict with the karate lesson times. The instructor (owner of the business) told me that was no problem and I would just need to give him a written 30 day notice to stop the automatic withdrawls. Which we did. The next month we were charged the $99 for the monthly fee, truthfully I did not notice it came out. The next month (August) the fee came out again, I noticed it this time because I didn't have enough in my account and it triggered an overdraft fee ($35). I quickly (same day) went and spoke with the owner. He stated he was sorry this was a mistake and he would clear it up tomorrow and get us a refund.
After 5 business days and no refund I tried to call him (business owner again) and constantly got voice mail. So I went in to see him again. Now he says there is a 12month contract and if you leave before the 12 months are up there is a $200 termination fee. Strange how that is almost the exact number they owe me. And I never signed anything about a 12 month contract.
Although I was pretty upset I did not (and still do not) know what I could do about this. Now today I see they have taken out another $99 for a total of $332 dollars.
Please help me here. I want to stop the automatic withdrawls and get back the $332 they owe me.
