    Default Increase in Income

    My question involves bankruptcy in the state of: Florida

    My husband and I filed Chap. 13 in 2011. He was 'sporadically' employed at the time but has since found full-time employment. We have not reported this to our attorney or the trustee. Will we get in trouble if we don't?

    You absolutely are required to report your change in income subsequent to filing Chapter 13. You are required by law to report these changes to the trustee. Chapter 13 debtors have a duty to use their "best efforts" to make a bankruptcy plan work. Debtors who see a significant increase in their income - for example, by getting a raise or taking on a second job - may be asked to increase their monthly payments.

    Failing to do so carries some serious consequences, up to and including losing your income discharge eligibility.

    Well, now I'm worried b/c he's been working since March. Is there a way to report this now without getting in trouble?
