    Default Frustrated at attorneys answer

I just came back from seeing a bankruptcy attorney. His advise was the longer I wait to file the better off I will be .I dont qulify for chapter 13 because of income but i don't qualify for a chapter 7 because i made to much money... This is do to the fact that I have 5 months of income,(from march -aug) and the longer I wait.. more of the months of employment come off . So if I wait until say Nov. to file then I will only have from May thru Oct. wages.(They go back to the last 6 months of employment history.) I know that chapter 7 is what I want to do but the attorney would not let me retain him for a fee and help stop the judement garnishment that is unevaiable in Oct. I postponed my court date because I was seeking an attorney. Now what can Ido? Would any one suggest I see another attorney ? The attorney I seen suggested that I try to settle this with the attorney that is sueing me.. Ya right, like he is gonna be willing to take payments monthly. He works for the credit card company. any suggestions on how to avoid the garnishment would be helpfull. I dont have the money to pay the bill in full because if I did I would have never allowed it to get to this point. ohhhh I am so frustrated!!

If you don't qualify for Chapter 7 bankruptcy due to the effect of the Bankruptcy Reform Act, frustrating though it may be, there's nothing a lawyer can do to change that.
