In 2000 - I was fired from my employer for embezzlement of an agent 10,000 - 20,000. In Sept 2001 I pled no contest and was sentenced to 5 years probation and to pay restitution of $10,000.00. I received a new job in Jan of 2001 - so on date of sentencing I paid $2500 upfront to victim and it's noted at courthouse. The next months were hard adjusting to the different income, etc... but I managed to pay $273 more in restitution at the courthouse. Leaving a balance of $7227. In 2002 - I was issued a summons to go to court to review our financial records, etc.... and was told to send payments directly to plaintiff. Unfortunately I never noticed until 1-1/2 months ago that there is a civil judgement (totally different case number) with $10,000 owing as well. I paid plaintiff in 2002-2003 total of $1800 directly - not through courthouse to show restitution was being paid upon. In 2003 I filed Chapter 13 bankruptcy as our house was going to be foreclosed upon. I'm still currently in Chapter 13 - but the restitution was set to be paid outside the plan. Financial hardship after another - I was to be released from probation on September 17th - but my fines are not paid - so the officer requested a probation revocation show cause hearing. I pled not guilty and they assigned me an attorney. I go to court on Monday Oct 2nd - but the attorney won't meet me until 15 minutes beforehand. I know these fines and costs are due - but I dont' have the money. I was let go of my previous job after 5 years in Jan 2006 due to downsizing and did get another job in April 2006 - but making $6.00 less per hour than before. And....bankruptcy payments are still the same. I just want to know what will happen on October 2nd? Will they send me to jail for being indigent and not having the financial resources to pay restitution? I don't mind if they extend probation - but I've already been on 5 years - not sure what the limit is? Any advise would be helpful. Should I tell my children goodbye Monday morning - or will there be sentencing date at hearing?
