My question involves a child custody case from the State of: Pennsylvania.

I married a legal resident of PA who will not obtain citizenship for another 3 years. He was abusive to me during my pregnancy, and refused to get off drugs until i was 6 months along. My son was 6 weeks old when he threw my son on the couch because he groaned in his sleep. He woke up my son every night so that he could have a "peaceful" nights sleep without my son waking him up while we both sleep and refused to even hold him. I reported this to my son's dr. and cys, and was advised to leave before it got worse. I left that day and my son is now 5 months old. He has not seen him since I left and he has been invited many times. He changes his mind daily on what he wants and ranges from telling me he wants to sign off his rights and have nothing to do with him, to informing me he will take him away from me when he is 2 or 3 and needs a father. He has a criminal history in another country, and past suicide attemps as well as being addicted to drugs and keeps relapsing.

I want to move to Another country to start a new life with some friends and obtain a job with my degree. I am not in favor with my husband being near my son after the way he has spoken about him recently, however, I have been in contact with his family in his native country to make arraingments for visitations with them and send them pictures and updates from time to time.

What are my chances of being rewarded sole custody with the ability to move out of the country once custody and divorce are obtained?
