My question involves an eviction in the state of: Wisconsin.
Myself and my fiance live in an apartment building with 8 units. Our previous roommate and his girlfriend befriended the elderly lady who lives one below and over from us. To be more specific, we are in the top back unit, she is in the front bottom unit. At first she was a nice older lady who had health problems and our previous roommate gave her his cell # and our home phone # in case of emergency. He also began visiting with her and running errands for her. My fiance and i also visited with her a handful of times. Soon though, she became a nuisance. Any errand you'd run for her was done wrong or you got the wrong stuff and she was not responding gratefully to the help. She also began using her illness as a manipulative tool - one minute she'd be fine, then when you wanted to leave she would be in pain. She would call his cell phone and our house phone multiple times in a row if no-one answered. Eventually our roommate moved out and we all stopped communication with and helping her. This has made her angry and she has since began a smear campaign against us saying that my fiance and our previous roommate (both young men) threatened her and stole from her. She will be nice the one day then the next will make up lies. She has also claimed my fiance makes too much noise outside at all times of night and that the young men scream in her window. Because these are all lies we have not received any similar complaints from neighbors, nor have we had any visits from the police. We have filed complaint forms with our apartment complex and have notified them every time she alleges a new complaint, as usually she complains to neighbors who tell us, not the apartment management.She is also quite creepy as she always looks out her window anytime you come, go, take your dogs out, etc. However, the situation has not died down despite our attempts to make peace. We ignore her and make all attempts to avoid her but she still persists. Our apartment management contacted their management and told us that if the situation does not stop, one or both of us may go. To me this sounds illegal. We are not in any sort of lease breach, have had only one noise complaint months ago do to our old roommate's dog barking, are up to date on rent, pay on time, and have received no complaints from neighbors or visits from police, and we are generally friendly to our neighbors - holding doors, etc. The only thing that i feel they could try to use as eviction grounds is the nuisance clause, but that specifically relates to excess noise, which we don't make. It takes 3 noise complaints to get evicted and we have only 1. We have not yet received a 5-days but i wanted to arm myself with knowledge in case this situation comes to it. Are there any legal grounds to be evicted because of these problems with our neighbor?
