    Default Father Never Showed Up to Court for Paternity Hearing

    My question involves paternity law for the State of: New Jersey

    My boyfriend was supposed to show up to court last week for a paternity hearing for a child that will be 4 yrs old April 2013. It was for child support as well. He never showed up. Does he still have the ability to contest paternity?

    Well he has an older child from a marriage. He is behind in child support so was concerned about that. Secondly, he didn't have legal counsel so he went the day-of to have a consultation. Attorney told him to come up with legal fees and have all the back support and he would reschedule the hearing. Today, the Probation court sent out confirmation of the child support that was set. No mention of paternity. But in the original court papers it was mentioned. He has not seen this child since the age of 9 months old. Lots of information behind the pregnancy, etc. and he always doubted he was the biological father. Just wondering if he can still do a Paternity test if child support has been ordered by the court. He was basically a no-show.

    he can always appeal to the court. If they accept his justification for not showing up, they can allow him a continuance.

    Thanks. Do you happen to know if the paternity was established during court, would some record of that been sent to my boyfriend along with the child support order? Just curious.

    They should send a finding. They would not enter a child support order unless they had determined he was the father, even if it was only by default.
