My question involves criminal law for the state of: Indiana

My husband recently was arrested for domestic battery and strangulation charges. However, I did not call 911. Someone seen me leave my apartment to sit in my car until things cooled off and they called 911. We were both highly intoxicated and got into a fight and I was taken to the hospital with injuries. I made a statement there, but I have no clue what I said because I was really drunk. They are charging him with strangulation because I had two very smalls marks on my neck. Can they do that? I have talked to the prosecutor, victims assistance, and the investigator from the prosecutions office. I have told them that I do not remember giving them a statement, I was not afraid of him, he has no history of this and I was not coming to their office for them to take additional pictures and I am not pressing charges and did not want this to be pursued any further. I also told them that we both got drunk and got into a fight I walked for things to cool off and someone called 911. So, he goes to court Monday so they can decide if it will be took by the state. What are his chances that they will not proceed with charges?
