    Default What Can the Police Do With Private Surveillance Video

    My question involves personal property located in the State of: California

    Hi,
    I have a question. If the police investigates a car accident or a homicide on the street and it requests the video tape of a camera installed by a store close to the crime scene. The video tape is the property of the store and the owner can deny the request. If the owner cooperates with the police, is the police required to have his permission to use any data from the video for any purposes?

    If the owner chooses to give the video to the police, then the police can use their copy of the video as they see fit. There will be laws and internal procedures that could potentially come into play in relation to handling and distribution of evidence. What's the actual issue?

    Hi,

    Thank you for your reply! There is no issue but I want to learn more about the law regarding ownership claim. The video content is not determined an evidence yet but the data that is processed or analyzed from the video content e.g. vehicle's license plate by any technologies or methods can be used for some purpose. Then who is the owner of these data?

    As was stated, if the police have lawfully obtained the video they can use the data for whatever lawful and appropriate purpose they see fit. if they observe evidence of an unrelated crime, they can use that as well. They can run the license plates of vehicle observed in the video provided the information is for a law enforcement purpose and not simply because the reviewing technician though the driver was hot and wanted to know how to find her.

    The data extracted from evidence can be used by the police for whatever lawful purpose might be necessary ... subject to laws or policies that might restrict redistribution of the data within.the
