    Default When Can Grandparents Be Required to Provide Support

    My question involves child support in the State of: New York / Florida

    My girlfriend just told me about this and it does not make any sense:

    My girlfriends 18 year old daughter just called her from New York, says she is sorry but she didnt have any choice because her 1 year old son needs medicaide and the State of New York DSS is going to be comming after her (my girlfriend who lives in Florida) for child support. Why will New York be comming after the grandmother for child support? The 18 year old daughter moved to New York to be with the babys father who is a 21 year old unemployed bum, We were told that DSS is putting them up in a motel for the moment until they can find housing for them. The 18 year old moved to New York against her mothers wishes and even the parrents of the babys father who pretty much dis owned their son after getting her pregnant and hauling butt to New York to avoid having to pay child support here in Florida. Wouldnt the state go after the babys father who is living there in New York with her AND the baby since he doesnt work? The other neat little tidbit of information she told her mom was that she would be responsible for this child support until she turned 21?

    To make sure you understand this.. My girlfriend is 43, her 18 year old daughter called her and told her that New York DSS is comming after her (43 year old girlfriend) for child support for her 1 year old GRANDSON and petition is filed by the 18 year old daughter and the New York DSS.

    Does this make any sense? The grandmother has no legal rights to the grandson, and she is going to be responsible for child support?

    Just because the daughter SAYS that DSS is going to require child support for the grandson, does not mean that DSS is actually going to do so. Could be the daughter misunderstood; could be she's trying to scare her mother into coughing up some money.

    Now, given that the state is NY, it's not altogether impossible that your gf could end up on the hook for support for the daughter, since I believe NY law provides for support till age 21. But for the grandson? I wouldn't panic until she is actually contacted by DSS.
