    Default How to Evict a Boyfriend Who Won't Leave

    My question involves an eviction in the state of: California

    I was with my boyfriend for ten years before recently breaking up with him. We have two kids together and we have all been living in the same house. I have supported our family the entire time we were together (he did have a job when we met but only for a few months). I own the home in my name only. I pay every single bill and he does not contribute to the household at all.

    Do I have to serve him with an eviction notice through the courts if he refuses to leave on his own? Does he have any rights? Does the past relationship exclude him from the "gratuitous guest" status?

    He is a resident and you will have to seek relief through the eviction process. He ceased to be a "gratuitous guest a decade ago.

    Chances are you can work out an arrangement that will get him to leave voluntarily long before any eviction could be completed.

    I had a chuckle at the decade ago comment - I wasn't sure what the definition was but I suppose I do now! Thanks so much for your reply! I had a feeling that was the course of action but wasn't sure. I imagine I don't have to continue to feed him etc., but he really doesn't have any other means and I've agreed to let him stay until he can get on his own two feet. I'm thinking about moving which is why this is so much of a concern.
