    Default Co-Signer for a Loan That Was Electronically Signed Without Consent

    My question involves collection proceedings in the State of: Tennessee

    My husband received calls and letters from Sallie Mae about 2 years ago,from where he co-signed 1 loan for his ex wife, while they were married. Sallie Mae was demanding repayment of $23,000.00. My husband asked for Sallie Mae to send him all paperwork about the loans, they never sent them. So we had to start paying them something or else. Well my husband kept telling me he only remembered signing for one loan. So about a month ago I emailed Sallie Mae asking for all paper work with my husbands signature on them. They sent some papers. Only one paper has my husband actual signature on it dated in 2005, on a co-borrower and promissory note ( no loan amount on this paper). The other 2 papers are e signed for the years of 2006 and 2007. My question is, is my husband responsible to repay these other 2 loans that he did not authorize? If not how do we go about getting dropped from having to repay the 2 loans?

    If a person establishes an E account for student loans, they agree to be bound to any loans acquired under their PIN. This is part of the FAFSA process. He is responsible for any loans acquired under his PIN.

    Your husband signed on paper or electronically? What does his contract as cosigner say about future loans?

    When your husband pointed out to Sallie Mae that he had only signed on the first loan, what did they say?

    My husband signed the first loan in 2005. The other two were typed in for 2006 and 2007. From the papers they sent us, and the one with an actual signature does not say anything about future loans. My husband is calling Sallie Mae in the morning to point all this out to them, so hopefully I will have more information soon.
