My question involves child support in the State of: Ohio
My husband was paying child support for his son from a previous relationship. His son turned 18 in June, and the child support order ended in July, because his son's mother did not submit proof that he is still high school. She requested a hearing from the child support agency, had the hearing today, and submitted something showing her son is supposedly still in high school. The child support order started back up as of today. Now the child support agency is showing (on their online payment status system) that my husband owes nearly 4 months worth of arrears. I'm worried now about how much is going to be withheld from my husband's paychecks in addition to the regular child support payments, to pay the arrears.
I know that in Ohio, up to 55% of the non custodial parent's income can be withheld, if they 12 or more weeks in arrearsm, and the non custodial parent has another family to support. Will the county/state automatically withhold 55% of my husband's paychecks until the arrears are paid? I'm unbelievably stressed out about this because I am laid off right now, and we are barely making ends meet as it is (we have two kids together). My husband's paychecks have also been garnished since August for an old city tax debt that we couldn't afford to pay. The city is taking 25% of each of his paychecks (after mandatory tax withholding) for that garnishment. If 55% of his paycheck gets taken for child support, on top of the tax garnishments, we literally won't be able to even pay our rent.
I know child support debts get first priority with garnishments. So, how will that affect the tax garnishment? Will the city still get 25% of his pay after the child support payments and taxes come out? Sorry if I'm rambling. I'm just upset and confused right now. Any advice would be greatly appreciated.
