    Default Other Employees Get Paid Vacations, But I Don't

    My question involves labor and employment law for the state of: California
    I've been working for the same company for some years now and have never received paid vacations while all the other employees are receiving sometimes up to two weeks.
    I feel discriminated against because i work a different shift that of everyone else but still i work work more hours than them(employees).

    If you're in the same classification as other workers who receive benefits and the only difference is that you work another shift, I'd definitely take issue with not being afforded the same benefits as other workers who do what I do. That said, we can't know whether the basis for the choice is unlawful discrimination. I'd take it up with the CA fair employment commission folks.

    When you discussed the possibility of paid vacation with your boss, what happened? When you looked up your employer's vacation policy in your employee handbook, what did you find?

    It is legal to discriminate on the basis of what shift you work.

    do you have reason to believe that the difference in perks/benefits is the result of your race, color, religion, sex, national origin, or Disability (or other state specific protected class)?

    if not you have no case for discrimination.
