    Default Delay in Order of Discharge After Completion of Repayment Plan

    My question involves bankruptcy in the state of: Texas

    How long should it reasonably take to get the motion for discharge granted after plan completion?
    I made my 60th payment and covered my plan base in early July. Case has been labeled "completed". Still in limbo, and I wish my attorney's office would return phone calls...

    There's clearly a problem or issue - but you've already figured that out. Have you checked the court file? Attempted to contact the trustee?

    Completed as of 7/6/12...
    Still can't get a return call from the atty.
    Following the court docket, even. No discharge in sight.
    Very frustrating.

    Still waiting to hear if the Motion for Discharge has even been filed!

    Did you do as Mr. K suggested and call your Trustee to find out when he/she will file his Notice of Completed Plan?

    Did you take the second credit counseling course - the Debtor Education Class - and file with the Court a Certificate of Completion? You are not entitled to a Discharge until that Certificate is filed.

    Did you file the Certificate of Eligibility for Chapter 13 Discharge? If not and this Certificate is required in your District, you are not entitled to a Discharge. Your District may have a specific form for this Certificate - you need to look into it.

    According to the Trustee's office, everything is in order. They are waiting on Motion for Discharge. They have even asked my atty why it's not been filed yet.
    I've sent a certified letter to my atty (and trustee) asking about the status of my case. Polite and succinct, asking if there's anything I need to do and inquiring about the status of my case. The lawyer for the Trustee called after having received the letter, saying that they have also asked my atty about the delay.
    If the Trustee has my back, I simply don't understand...

    Frustrating.
