    Default Can I Go to Traffic School as Many Times as I Want

    My question involves a traffic ticket from the state of: CALIFORNIA
    I was going to work on the freeway 65 mph speed limit and i passed a sheriff at around 70 mph. I kept on going and knew full well he was behind me and kept at a constant speed of 70-75 mph, after following me for about 5 miles he pulled me over. I pulled off the freeway and pulled onto a safe part of the street. He proceeded to my window and asked for my license and registration. I wanted to try something my friend told me about. So i told the officer that i was going to record this conversation and he asked me why, and i told him for quality assurance, he seemed a little disturbed by this. I then proceeded to ask his name and badge number, he began to be agitated by my questions. And when i asked for his superior, he stated that he is the watch commander on this shift, and i asked if there was someone i can talk to, to verify his identity and he stated that he could show me his id and he is in his uniform and he could have a unit come down to verify his identity. And then i asked if he had proof of claim of my speeding....and without hesitation he said "step out of the vehicle" and i asked why? and he told me because he instructed me to do so. I was shaking and was scared b/c i didnt know what to do next, so i got out of the vehicle, and then he took my phone the recording device and threw it on my chair and i proceeded to his car to be padded down and he wrote me a citation 22349(a) for 75 mph saying he paced me. all throughout the conversation i stated to his statements that i understand what you are saying but you have no proof of claim. And when i said heresay is not admissible in court, he said it was.

    MY QUESTIONS ARE: i just went to traffic school this past month, but my friend told me that there is a penal code allowing me to go to traffic school as many times as i want, is this true? also what are my chances in traffic court, do sheriffs usually show up? and did this officer behave in a disrespectful manner?

    There was a section of the vehicle code that allowed a second trip to traffic school (12 hour long traffic school), but it just removed the point and not the entry. Insurance companies know what a 22349(a) violation without a point means.

    Chances in traffic court? Normally, it depends even if it's low. You, however, choose to make a production out of your traffic stop. Personally, I try to be as inconspicuous as possible. I don't want the officer to remember my stop specifically. On the other hand, between the "I'm recording you and want your watch commander, and want to verify your identity," uh, bull dung have pretty much guaranteed that the officer will remember your stop and will do just about anything possible to show up. By you acting disrespectful (regardless of whether you think the officer deserves respect or not), you've shot yourself in the foot.

    Dumb ass moves # 1, and #2 especially if you're going to piss your pants when the cop has had enough!

    As far as traffic school, you could always take traffic school as many times as you want, but it will only work to get you a dismissal of a qualified infraction once every 18 month period. Your second friend is wrong about the traffic school matter. As CS explained....

    The friend who I have issues with is the one feeding you all these daft ideas about telling the cop you're going to record your “conversation”. I mean, knowing you're recording him, what do you expect him to say to you that he isn't supposed to say, all while knowing that are recording the conversation? Do you see how that was a stupid idea?

    It gets even worse when we get to the list of questions you asked, whoever came up with those clearly had the one objective of irritating the calmest, coolest of cops. And you got pretty lucky thins time... Next time, you might get the asshole sheriff who'll likely make your quality assurance test an incident you'll remember for quite some time!

    I love the fact that you turned out to be a woos that you are... You started shaking!!! They are probably still laughing at you at the sheriff station after he told everybody your story.

    He should have cuffed you and thrown you in the back seat too... Then again, he would have had to clean your seat up when he 's done...

    Do you even know what that means? And where do you get the idea that he needs any proof of anything to cite you? You can save that for court, in fact, I dare you to tell that to the judge. (You should wear a diaper though when you appear in court... Just in case)!

    For starters, you broke the universal rule which states “if you cannot spell it, you are not allowed to use it. Aside from that, what part of anything that occurred there had anything to do with hearsay? The answer there is “nothing”. So what was the point of you bringing it up?

    You have a zero chance of beating this citation. California Student explained that perfectly. Of course you are always within your rights to contest it... Doing so, you can be sure it will be a humiliating experience and so I do hope you will contest it simply because I think you need to be taught a lesson. A lesson that the judge will be more than happy to give you once the officer recites the story in court.

    Are you really this obtuse?
    Could you be any more fake and pretentious woos?
    What are you going to do if he was disrespectful?
    And even if he was, you do realize that it will have zero impact on your guilt or innocence in the speeding case? H yeah.. Your complaint against the sheriff will be investigated by the department. You speeding case will be decided in court.
    A better question to ask yourself is this; did your friend pull a fast on you by setting you up to do something that he himself was too chicken to do?

    I think the officer did the opposite of disrespectful. I think he should have arrested you and taken you in.. For what? How about obstructing an investigation? I mean he pulls you over, intends on citing you for being foolish and passing him at a higher speed than the state's maximum, and you waste his time by being uncooperative and further laying out this asinine schpeal that is neither relevant nor appropriate. Its people like you who make contact with officers a difficult task for the rest of us...

    You don't need a penal code to go to traffic school. You may go as many times as you wish. In fact, we encourage you to do so, until you learn how to drive safely.
