    Default Child support between New York and Florida

    I was divorced in NY. Seven months ago my ex wife moved to FL with my daughters, 17 and 19. They didn't register for school when they arrived and my ex didn't make them. When school started in Aug., my ex made up an excuse and delayed registering my 17 yr old for 2 wks. I just discovered my daughter is no longer enrolled due to lack of attendance. Of course, when I ask how school is going, I get the answer "fine". I am going to file a petition to stop child support as my youngest will be 18 soon and I do not feel my child support should support my ex, her boyfriend and his son, my daughters, and their 2 boyfriends. They should not be allowed to sit around all day not working or attending school as they are all old enough to find jobs. Neither of my daughters formally dropped out of school. I have sent a check every week since I was first separated. I have never been taken to court over child support issues. The only documentation is in my divorce papers. I need advice as I am aware the NY child support standards state age 21 and FL is 18.

    Your divorce case was in NY so it holds jurisdiction. Why on Earth did you not also get custody, child support and visitation orders with your divorce? Did your wife have permission to move? You are responsible for your children until age 21 unless they become emancipated and techincally there are no formal emancipation laws in NY but there are some limitations, after they have established residnece in FL usually after 6 months it may be possible to emancipate them under FL law so it is possible that you won't owe child support, if you have no order and stop paying, she may try to file for it, but it would have to be in NY. I strongly suggest you consult a NY family law attorney ASAP. Actually if she wanted you to support everyone, it would have been easier if they stayed in NY until the youngest was 21.
